Certified translation of a foreign degree for an H-1B petition and credential evaluation
An H-1B specialty occupation petition rests on the beneficiary's degree, and when that degree was earned outside the United States the regulation gives the employer a way to prove it is equivalent to a US bachelor's or higher. 8 CFR 214.2(h)(4)(iii)(D) lists an evaluation of education by a reliable credentials evaluation service which specializes in evaluating foreign educational credentials among the accepted proofs, without naming any association or list. Someone has to determine the equivalence, and the next paragraph says who may.

The regulation names no association and no approved list, so the evaluator's own reputation and the quality of its report carry the weight.

What an H-1B file with a foreign degree requires
- To qualify for a specialty occupation the beneficiary must hold a US bachelor's or higher degree, a foreign degree determined to be equivalent, an unrestricted state license, or education, training and experience equivalent to the degree.
- Equivalence to a US degree may be determined by, among other means, an evaluation of education by a reliable credentials evaluation service which specializes in evaluating foreign educational credentials, or by a college official with authority to grant college level credit.
- For equivalence through experience, three years of specialized training or work experience must be demonstrated for each year of college level training the beneficiary lacks.
- Any document containing foreign language submitted to USCIS must be accompanied by a full English translation certified by the translator as complete and accurate, with the translator's certification of competence.
- The regulation names no approved evaluator list; USCIS's H-1B page repeats the equivalent foreign degree criterion and says nothing about specific evaluation services.
Common reasons translations get rejected
- A summary translation of the transcript. The regulation says full, and an evaluator writing a course by course report cannot count courses it cannot see.
- A translation without the competence statement. USCIS's rule has two certifications, accuracy and competence, and a certificate that carries only one is incomplete.
- Translating for the evaluator and again for the petition. One certified translation with the regulation's statements serves the evaluation service, the attorney and USCIS.
- An evaluation with no roadmap. USCIS calls conclusory opinions unpersuasive; a course by course report built on a complete transcript translation is the roadmap.
