Terms of Service
Effective July 25, 2026
These Terms of Service ("Terms") are a binding agreement between you and Future Gen Sync LLC, a Wyoming limited liability company doing business as Eagle Translate ("Eagle Translate," "Company," "we," "us," or "our"). These Terms govern your access to eagletranslate.com, your account, and all related quoting, ordering, document-upload, marketplace, payment, delivery, support, and other services (collectively, the "Service").
Important: Eagle Translate is a technology marketplace, payment-collection channel, and delivery platform. Future Gen Sync LLC does not itself author, approve, or certify translations. Independent translators perform the professional translation service and are solely responsible for their translations, credential statements, professional review, signatures, and certifications. We do not authenticate source documents, determine whether they are genuine, give legal advice, file documents, or guarantee that any recipient will accept a translation except to the limited extent expressly stated in our Refund Policy.
By creating an account, placing or paying for an order, uploading a document, clicking an acceptance box, or otherwise using the Service, you agree to these Terms, our Refund Policy, Privacy Policy, and Security Policy. If you do not agree, do not use the Service.
1. Marketplace Relationship; Customer-Translator Agreement
Eagle Translate provides marketplace technology, order administration, payment collection, workflow tools, file delivery, and customer support that enable customers to engage independent translators. Future Gen Sync LLC does not itself perform the professional translation, become the author of the final translation, or sign or issue the translator's certification.
When an independent translator accepts an order, a separate agreement for the professional translation services described in that order is formed directly between the customer and that translator (the "Translation Agreement"). The Translation Agreement includes the applicable order confirmation, source and target languages, deliverables, certification requirement, deadline estimate, customer instructions, these Terms to the extent they allocate customer responsibilities, and the translator's professional obligations. Future Gen Sync LLC is not a party to, guarantor of, employer under, or professional service provider under the Translation Agreement.
The customer authorizes the Company to administer the order, collect payment as the translator's limited payment-collection agent, deduct disclosed platform or service amounts, arrange contractor compensation under separate terms, transmit files and communications, and deliver the completed work. Payment successfully received by the Company satisfies the customer's payment obligation to the translator for that order to the extent of the amount received and not reversed. This limited administrative and collection role does not make the Company responsible for the translator's acts, omissions, professional judgment, work product, signature, certification, or legal compliance.
Each translator is an independent business and is not an employee, general agent, partner, joint venturer, or legal representative of Future Gen Sync LLC. A translator has no authority to bind the Company, promise a refund on its behalf, or make admissions for it. The translator whose name or approval appears on a certificate is solely responsible for having personally performed or professionally reviewed the complete translation and for the accuracy, completeness, competency, credential, signature, and certification statements made.
We may screen or verify credentials, match orders, provide certificate templates, glossaries, and reference materials, maintain quality and security rules, investigate complaints, request corrections, administer a refund, suspend access, or remove a translator from the marketplace. Those administrative activities do not transfer authorship or certification responsibility to the Company, create employment, or guarantee that a translator will never make an error.
To the maximum extent permitted by law, claims concerning translation accuracy, omissions, professional negligence, competency, credential representations, or certification are obligations of the responsible translator under the Translation Agreement. Nothing in these Terms excludes a responsibility that applicable law does not permit a party to exclude.
2. Eligibility and Authority
You must be at least 18 years old and legally capable of entering a contract. If you use the Service for another person, a business, or an organization, you represent that you have authority to bind that person or entity and that "you" includes both you and that person or entity.
You may not use the Service if you are prohibited from doing so by applicable law. We may request information reasonably necessary to confirm account ownership, payment authorization, or authority to submit documents.
3. Translation Scope
An order covers only the files, source and target languages, service level, format, page or word count, and optional services shown in the order confirmation. Handwriting, seals, stamps, marginal notes, images, tables, formatting, illegible material, or text embedded in graphics may require additional time, cost, or instructions.
Unless the order expressly says otherwise:
- the Service does not include legal advice, legal research, immigration advice, filing, form completion, case strategy, authentication, apostille, notarization, certified copies, credential evaluation, interpretation, localization testing, or delivery of physical originals;
- a translation reflects the source material supplied to us and does not correct, validate, or improve the source document;
- a certificate of translation accuracy addresses the completeness and accuracy of the translation, not the truth, legality, authenticity, validity, admissibility, or evidentiary weight of the source document; and
- delivery dates and turnaround times are good-faith estimates, not guaranteed deadlines.
We may correct quoting, page-count, word-count, language-pair, or service-description errors. If a material correction changes the price or schedule, we may pause the order and request your approval. If you do not approve, we may cancel the unperformed portion and refund the amount paid for that portion.
4. No Authentication, Legal Review, or Government Representation
Independent translators provide language services through the Eagle Translate marketplace; the Company provides technology and administrative services only. Neither the Company nor a translator:
- verify the authenticity, origin, legal validity, completeness, accuracy, or current status of a source document;
- determine whether a document was lawfully issued or obtained;
- investigate fraud, identity, immigration eligibility, legal rights, academic standing, medical facts, or the truth of any statement;
- advise you which documents to file or whether a translation satisfies a law, court, agency, school, employer, licensing board, or other recipient;
- represent you before any government agency, court, school, or institution; or
- promise any legal, immigration, academic, licensing, employment, medical, or business outcome.
No website content, customer-support message, translation note, or translator communication is legal advice or creates an attorney-client, fiduciary, immigration-consultant, or professional-adviser relationship. You should obtain advice from a qualified attorney or other licensed professional regarding your underlying matter.
5. Recipient Requirements and Acceptance
Requirements vary by recipient and may change without notice. Before ordering, you must confirm all requirements directly with the intended recipient, including language direction, certification wording, wet signature, notarization, apostille, physical copy, translator credentials, formatting, delivery method, and filing deadline.
A statement that a translation is "certified," "ATA certified," "accepted for official use," "suitable for immigration," or similar language describes the service format or common use; it is not a promise of acceptance by every recipient. Membership in or certification by the American Translators Association belongs to the individual translator, not to Eagle Translate, unless we expressly state otherwise.
We may attempt to verify translator credentials, but credentials can expire, change, be limited by language pair, or be inaccurately reported. The translator remains solely responsible for the truth and current status of credential information and for signing only work the translator is competent to certify. You may independently verify a translator's credential with the issuing organization.
Our only acceptance-related remedy is the limited remedy, if any, stated in the Refund Policy. Rejection caused by source-document authenticity, recipient discretion, a changed rule, a filing issue, a missed deadline, an omitted service, customer instructions, or any reason other than a verified translation error is not our responsibility.
6. Customer Documents: Sole Responsibility, No Verification, and Indemnity
You have sole and exclusive responsibility for every source document and for all information, spellings, instructions, and reference materials you submit. The Company does not verify, and is not engaged or qualified to determine, whether any source document is genuine, accurate, complete, current, lawfully issued, lawfully obtained, unaltered, admissible, or suitable for your intended use. We and the assigned translator may rely on the material exactly as submitted without independent investigation.
You represent, warrant, and certify that:
- each document and all information you provide are genuine to the best of your knowledge, complete, accurate, unaltered except for changes you clearly disclose, and not misleading;
- you own the material or have all permissions, consents, and lawful authority needed to upload it, disclose it to the Company, the assigned translator, and necessary service providers, obtain a translation, and use the resulting work;
- your submission and intended use do not violate any law, court order, confidentiality duty, intellectual-property right, privacy right, or other right of any person;
- you have disclosed the correct source and target languages, intended use, recipient requirements, preferred spelling of names, and any deadline that may affect the order; and
- you will not use the Service to fabricate, alter, conceal, misrepresent, or give false legitimacy to evidence, identity records, immigration records, academic records, medical records, court records, financial records, or any other document.
Neither the Company nor a translator has a duty to detect or report whether a document is forged, altered, expired, incomplete, illegally obtained, inaccurate, or otherwise invalid. A translation or certificate confirms only the translator's professional statement concerning the translation; it does not authenticate, validate, legalize, endorse, or give evidentiary weight to the source document.
If a document concerns another person, including a minor, patient, student, employee, client, or family member, you represent that you are authorized to act for that person or otherwise have a lawful basis to submit the document. You are solely responsible for obtaining every consent, authorization, or notice required by privacy, health-data, education, employment, court, contractual, or other applicable law.
To the maximum extent permitted by law, the Company has no responsibility or liability for any rejection, investigation, penalty, claim, loss, delay, or adverse legal, immigration, court, academic, licensing, employment, medical, financial, or other consequence caused by or relating to the authenticity, falsity, alteration, illegality, incompleteness, inaccuracy, ownership, admissibility, or use of a source document. Your defense and indemnification obligations for those matters are stated in Section 17.
7. Customer Review and Revision Requests
You must promptly review the delivered translation, including names, dates, numbers, addresses, identification numbers, stamps, seals, and formatting. You must report a claimed error through the order page or at support@eagletranslate.com within 30 calendar days after delivery and identify the disputed text with enough detail for review.
We may ask for clarification, proof of the recipient's requirement, or a legible source. We may have the original translator or another qualified translator review the issue. A reasonable difference in style, word choice, transliteration, or professional judgment is not necessarily an error.
Free revisions apply only when necessary to correct a verified error against the source material originally submitted. New or changed source material, new instructions, a different recipient requirement, a preferred style change, or an added service may require a new order or fee.
Failure to review or report an issue within the revision window does not waive a right that cannot lawfully be waived, but it may limit our ability to investigate, correct, or offer a voluntary remedy.
8. Orders, Prices, Payment, and Taxes
Prices are shown in U.S. dollars unless stated otherwise. You authorize us and our payment processor to charge the payment method you provide for the order, approved changes, taxes, and disclosed fees. Your bank or card issuer may impose exchange, international, or other charges that we do not control.
Payment is due before work begins unless we approve written credit terms. We may pause, refuse, or cancel an order because of payment failure, suspected fraud, prohibited content, translator unavailability, inaccurate scope, technical limitations, or legal risk.
You must not initiate a chargeback for a matter covered by our revision or refund process without first giving us a reasonable opportunity to address it. This does not limit rights provided by law or by your card issuer. Fraudulent chargebacks, payment reversals, or unpaid balances may result in account suspension and recovery of lawful collection costs.
You are responsible for sales, use, value-added, withholding, or similar taxes imposed on your purchase, except taxes measured by our net income.
9. Changes and Cancellations
You may request an order change or cancellation. Whether it can be made depends on the work already assigned or completed. Because translation work is personalized and begins quickly, an order is not automatically refundable after work starts.
Refunds, cancellation amounts, revised pricing, acceptance remedies, and turnaround issues are governed by the Refund Policy. If there is a conflict, the Refund Policy controls only as to refunds and cancellations; these Terms control all other matters.
10. License to Process Customer Content
You retain your ownership rights in documents and other material you submit ("Customer Content"). You grant Future Gen Sync LLC a nonexclusive, worldwide, royalty-free, limited license to host, copy, transmit, display, format, convert, disclose to assigned translators and service providers, and otherwise process Customer Content only as reasonably necessary to:
- provide, secure, support, and improve the requested Service;
- prevent fraud, misuse, and security incidents;
- comply with law, enforce these Terms, and resolve disputes; and
- create deidentified or aggregated operational data that does not reasonably identify you or any individual.
You may revoke this license for future processing by deleting eligible content or your account, subject to ongoing orders, legal obligations, security needs, dispute preservation, and the retention practices described in the Privacy Policy.
We do not claim ownership of Customer Content. We do not sell source documents or translated documents.
11. Confidentiality, Privacy, and Security
We require assigned translators to treat Customer Content as confidential and to access only the material needed for their assignments. We use service providers for functions such as hosting, file storage, payment processing, communications, analytics, and security.
Our collection and use of personal information are described in the Privacy Policy, including its Sensitive and Health Data Notice for medical or health-related documents. Our general safeguards are described in the Security Policy.
No internet transmission, cloud service, or storage system is completely secure. You are responsible for using a secure device and network, protecting account credentials, limiting the personal information you upload to what is needed, and downloading completed work promptly.
12. Prohibited Uses
You may not:
- submit false, forged, stolen, unlawfully obtained, or misleading documents;
- use a translation to deceive a court, agency, school, employer, financial institution, health provider, or any other person;
- request a translator to omit, add, conceal, or change source meaning without clearly marking the result as an adaptation rather than a faithful translation;
- infringe intellectual-property, privacy, publicity, confidentiality, or contractual rights;
- upload malware or content designed to disrupt or gain unauthorized access;
- probe, scan, scrape, reverse engineer, overload, bypass, or interfere with the Service or its security;
- impersonate another person, misstate authority, or use another person's payment method without permission;
- harass translators, staff, or other users; or
- use the Service for unlawful, sanctioned, abusive, discriminatory, or exploitative activity.
We may refuse, suspend, preserve, or report content or activity when we reasonably believe doing so is necessary to protect a person, prevent fraud or harm, comply with law or legal process, or enforce these Terms. We have no general duty to monitor documents for illegality or inauthenticity.
13. Intellectual Property
The Service, website design, software, workflows, trademarks, logos, templates, and non-customer content are owned by Future Gen Sync LLC or its licensors and are protected by law. Subject to these Terms and full payment, we grant you a limited, nonexclusive, nontransferable right to use the delivered translation for your lawful personal or business purposes.
You may not copy, resell, frame, scrape, or create derivative services from the platform or our proprietary materials except as permitted in writing. "Eagle Translate" and associated marks may not be used without our prior written consent.
Feedback you voluntarily provide may be used by us without restriction or compensation, but we will not publicly identify you as its source without permission.
14. Third-Party Services and Links
The Service may depend on third-party payment processors, hosting services, file-storage services, email providers, analytics tools, shipping carriers, or links to other websites. Their services and terms are outside our control. To the maximum extent permitted by law, we are not responsible for third-party outages, delays, acts, omissions, data practices, or content.
15. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, PLATFORM, WEBSITE CONTENT, TRANSLATIONS, CERTIFICATIONS, AND DELIVERABLES ARE PROVIDED "AS IS" AND "AS AVAILABLE." FUTURE GEN SYNC LLC DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, SECURITY, UNINTERRUPTED AVAILABILITY, AND RESULTS.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- A TRANSLATION OR CERTIFICATION WILL BE ERROR-FREE;
- A SOURCE DOCUMENT IS AUTHENTIC, VALID, ACCURATE, OR LAWFUL;
- A TRANSLATOR'S CREDENTIAL WILL REMAIN CURRENT OR APPLY TO EVERY LANGUAGE PAIR OR DOCUMENT TYPE;
- A RECIPIENT WILL ACCEPT A TRANSLATION;
- A TRANSLATION WILL PRODUCE A PARTICULAR LEGAL, IMMIGRATION, ACADEMIC, MEDICAL, LICENSING, EMPLOYMENT, OR BUSINESS OUTCOME; OR
- THE SERVICE WILL MEET A DEADLINE OR BE AVAILABLE WITHOUT INTERRUPTION.
THE LIMITED CORRECTION AND REFUND COMMITMENTS EXPRESSLY STATED IN THE REFUND POLICY ARE THE ONLY SERVICE GUARANTEES WE PROVIDE.
Some jurisdictions do not allow certain warranty exclusions. In that event, the exclusions apply only to the maximum extent permitted by law.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURE GEN SYNC LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, OPPORTUNITY, DATA, GOODWILL, OR USE; COST OF SUBSTITUTE SERVICES; MISSED DEADLINES; REJECTED FILINGS; ADVERSE LEGAL OR IMMIGRATION OUTCOMES; OR CLAIMS BY A RECIPIENT OR OTHER THIRD PARTY, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR ORDER OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EAGLE TRANSLATE FOR THE AFFECTED ORDER DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) USD $100.
These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited, including liability for the Company's fraud or willful misconduct where such limitation is prohibited. They do not reduce any specific refund due under the Refund Policy.
17. Customer Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Future Gen Sync LLC and its members, managers, officers, employees, affiliates, agents, service providers, and translators from third-party claims, investigations, penalties, losses, liabilities, damages, judgments, and reasonable attorneys' fees arising out of or relating to:
- Customer Content, including an allegation that it is false, forged, altered, unlawfully obtained, defamatory, confidential, infringing, or submitted without authority;
- your intended or actual use of a source document or translation;
- your breach of these Terms or violation of law or another person's rights;
- instructions to omit, modify, or characterize content inaccurately; or
- a dispute about the authenticity, truth, ownership, legality, admissibility, or effect of a source document.
We may control the defense and settlement of an indemnified claim. You may not settle a claim in a way that admits fault by, imposes duties on, or uses the name of an indemnified party without our written consent. This section does not require a consumer to indemnify us for our own conduct to the extent prohibited by law.
18. Suspension and Termination
You may stop using the Service at any time. We may refuse an order, suspend access, or terminate an account immediately if we reasonably believe there is fraud, nonpayment, a security risk, prohibited activity, abuse, legal exposure, or a material breach of these Terms.
Termination does not cancel payment obligations, completed orders, rights accrued before termination, or provisions that by their nature should survive, including ownership, licenses needed for recordkeeping, disclaimers, limitations, indemnity, dispute resolution, and general terms.
Account closure does not require deletion of records that we may retain under the Privacy Policy or applicable law.
19. Informal Dispute Resolution
Before starting arbitration or litigation, the claimant must send a written notice to support@eagletranslate.com describing the dispute, the relevant order number, the requested relief, and contact information. The parties will make a good-faith effort to resolve the dispute for 30 days after receipt. A limitations period is tolled during this 30-day process to the extent permitted by law.
20. Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO GO TO COURT.
Except for an individual small-claims action, a request for temporary injunctive relief to protect confidential information or intellectual property, or a matter that applicable law makes non-arbitrable, any dispute arising out of or relating to the Service, an order, these Terms, or the relationship between you and Future Gen Sync LLC will be resolved by binding individual arbitration.
The Federal Arbitration Act governs this arbitration agreement. To the extent state arbitration law applies and is not preempted, the Wyoming Uniform Arbitration Act, W.S. 1-36-101 through 1-36-119, applies. Arbitration will be administered by the American Arbitration Association ("AAA") under its applicable Consumer Arbitration Rules. The arbitration may occur by video, telephone, documents-only procedure, or, if an in-person hearing is required, in Sheridan County, Wyoming, as the rules and arbitrator permit. We will pay arbitration fees to the extent required by the AAA rules or applicable law. Each party will bear its own attorneys' fees unless a statute or the arbitrator authorizes otherwise.
The arbitrator may award the same individual remedies a court could award but may not combine claims or preside over a class, collective, coordinated, consolidated, mass, private-attorney-general, or representative proceeding except where applicable law does not permit that restriction.
You and Future Gen Sync LLC waive trial by jury and agree to bring claims only in an individual capacity, not as a plaintiff or class member in a class, collective, consolidated, mass, or representative action.
If the class-action waiver is finally held unenforceable as to a particular claim or remedy, that claim or remedy will proceed in court after all arbitrable matters are completed.
You may opt out of this arbitration agreement by emailing support@eagletranslate.com within 30 days after the date you first accept these Terms. Your notice must include your full name, account email, and a clear statement that you opt out of arbitration. Opting out will not affect your access to the Service.
Nothing in this section prevents either party from reporting a matter to a government agency or from seeking a remedy that applicable law permits through an agency.
21. Governing Law and Court Venue
These Terms and any non-arbitrable dispute are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration as stated above.
Subject to Section 20, any non-arbitrable action must be brought exclusively in the state courts located in Sheridan County, Wyoming, or the United States District Court for the District of Wyoming if it has subject-matter jurisdiction. Each party consents to personal jurisdiction and venue in those courts. If applicable consumer law requires a different forum or law, that mandatory requirement controls.
22. Electronic Records and Signatures
You consent to conduct transactions electronically and to receive agreements, notices, invoices, records, and disclosures electronically. Your click, typed name, account action, payment, or other electronic acceptance is intended as your electronic signature. Electronic records, electronic contracts, and electronic signatures may have legal effect under the Wyoming Uniform Electronic Transactions Act, W.S. 40-21-101 through 40-21-119, including W.S. 40-21-107, and other applicable law.
You may withdraw consent to future electronic communications by contacting support@eagletranslate.com, but doing so may require you to stop using online features. You are responsible for maintaining an accurate email address and equipment capable of accessing and retaining electronic records.
23. Changes to the Service or Terms
We may modify the Service, pricing, or these Terms. Material changes will apply prospectively and will be posted with a new effective date; when required, we will provide additional notice or request renewed assent. Changes do not retroactively alter a paid order unless you agree or the change is required by law.
Continued use after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
24. General Terms
These Terms and the policies incorporated by reference are the entire agreement concerning the Service and supersede prior or contemporaneous communications on the same subject. An order confirmation may add order-specific terms; if it conflicts with these Terms, the order confirmation controls only for that order and only to the extent it expressly identifies the conflict.
If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, financing, reorganization, sale of assets, or by operation of law.
Except for rights arising under a Translation Agreement and the rights of indemnified parties expressly stated in these Terms, nothing in these Terms creates third-party beneficiary rights. Headings are for convenience only. "Including" means "including without limitation." Notices to us must be sent using the contact information below. Notices to you may be sent to your account email or posted in the Service.
