Apostilles and notarization in New Mexico
The Office of the New Mexico Secretary of State is the only office in New Mexico authorized to issue an apostille, handled by the Business Services Division at 325 Don Gaspar, Suite 300, Santa Fe.
The apostille fee is 3 dollars per document, and requests can be filed online through the Secretary of State's enterprise portal, in person, or by mail.
A private document must first be notarized by a New Mexico notary before the Secretary of State can attach an apostille. Public documents must be certified copies from the issuing agency, such as a county clerk or the State Registrar of Vital Records.
New Mexico attaches the apostille to the original document with an eyelet that cannot be removed without invalidating the certification.
New Mexico notaries may not certify photocopies of vital records. Certified copies of birth and death certificates may be obtained only from the State Registrar of Vital Records before they can be apostilled.
USCIS itself does not require notarized translations for New Mexico filings. It requires a certification signed by a qualified professional translator attesting that the translation is complete and accurate, so notarization is only needed when a specific receiving office asks for it.
A translator's signed statement of accuracy enters the New Mexico apostille chain only after it is notarized by a New Mexico commissioned notary, since the Secretary of State issues apostilles for notarized documents.
New Mexico operates under the Revised Uniform Law on Notarial Acts and permits remote online notarization by authorized New Mexico notaries.

- A term with no exact United States equivalent is rendered to carry the meaning it has in the system that issued it, rather than swapped for an American term that would change what the document says. Where a term needs explaining, the explanation sits in brackets beside it instead of replacing it.
- A document has been asked for at short notice. How quickly can it be done?
- Certified delivery is 2 to 3 business days. Through 31 December 2026 the upgrade to Premium 1 to 2 business days delivery is applied automatically at the Certified price, so the faster option costs the same as the standard one.
- What does the certificate attest to?
- It attests to the accuracy of the translation. It states in those words that it does not attest to the authenticity of the source document or to the truth of its contents. That boundary is what makes it a certification a reviewer can rely on rather than a claim about your evidence.
